Terms of Service
These terms govern your use of tekko.id's services. Please read them carefully before engaging with us.

1. Acceptance of Terms
By accessing our website at tekko.id, engaging our services, or signing any project agreement with tekko.id ("Company," "we," "our," or "us"), you ("Client," "you," or "your") agree to be bound by these Terms of Service ("Terms").
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms. If you do not have such authority, or if you do not agree with these Terms, you must not use our services.
Summary: By working with us or using our website, you agree to these Terms. If you disagree with any part, please don't use our services.
2. Description of Services
tekko.id provides software development and digital product services including, but not limited to:
- Custom web and mobile application development
- MVP (Minimum Viable Product) development and prototyping
- UI/UX design and product strategy
- API development and third-party integrations
- Technical consulting and system architecture
- Ongoing maintenance, support, and optimization
- Landing page and CMS development
The specific scope, deliverables, timeline, and pricing for each engagement are defined in a separate Statement of Work (SOW) or project agreement executed between the parties. These Terms apply to all such engagements unless expressly superseded by a written agreement signed by both parties.
3. Eligibility
You must be at least 18 years of age to use our services. By using our services, you represent and warrant that:
- You are at least 18 years old
- You have full legal capacity to enter into a binding agreement under the laws of your jurisdiction
- If acting on behalf of a legal entity, you are duly authorized to do so
- Your use of our services does not violate any applicable laws or regulations
4. Client Obligations
To ensure a successful project outcome, you agree to:
4.1 Provide Accurate Information
Supply complete, accurate, and timely information, content, materials, and feedback required for the completion of the project. Delays caused by late or incomplete information from your side may affect project timelines and could result in additional charges.
4.2 Timely Review and Approval
Review and provide feedback or approval on deliverables within the timeframe specified in the project agreement. Unless otherwise agreed, if no feedback is received within 14 business days, deliverables will be deemed approved.
4.3 Authorized Use
Ensure that all content, data, and materials you provide to us are legally owned by you or that you have the necessary rights and permissions to use them. You must not submit materials that infringe on any third-party intellectual property rights.
4.4 Payment
Make timely payments in accordance with the agreed payment schedule. See Section 6 (Payment & Billing) for full details.
4.5 Lawful Use
Use our deliverables only for lawful purposes. You must not use any work product we create to engage in illegal activities, deceive consumers, infringe on third-party rights, or violate any applicable laws or regulations.
5. Our Obligations
tekko.id commits to:
- Deliver services with professional care, skill, and diligence consistent with industry standards
- Assign appropriately qualified personnel to your project
- Communicate project progress, risks, and issues in a timely and transparent manner
- Keep your confidential information secure and use it only for the purposes of delivering the agreed services
- Deliver agreed milestones within the timelines specified in the project agreement, subject to timely receipt of required inputs from you
- Provide reasonable post-launch support as defined in the project agreement
6. Payment & Billing
6.1 Fees and Payment Schedule
All fees are specified in the project proposal or Statement of Work. Unless otherwise agreed, the standard payment structure is:
- 50% upfront — due upon signing the project agreement
- 50% upon completion — due prior to final delivery or deployment
For larger or longer-term projects, milestone-based payment schedules may be agreed upon in writing.
6.2 Currency and Methods
All fees are quoted in Indonesian Rupiah (IDR) unless otherwise specified. We accept payment via bank transfer, credit card, and other methods as agreed. Payment confirmation is required before work begins on subsequent phases.
6.3 Late Payments
Invoices are due within 7 business days of issuance unless otherwise stated. Late payments may incur a monthly interest charge of 2% on the outstanding balance. We reserve the right to pause or suspend work on any project where payment is overdue by more than 14 days.
6.4 Taxes
All prices are exclusive of applicable taxes, including Indonesian VAT (PPN) where applicable. You are responsible for all taxes, duties, or levies imposed by any governmental authority on your purchase of our services.
6.5 Refund Policy
Upfront payments are generally non-refundable once work has commenced, as they cover resource allocation and preparatory work. If we fail to deliver the agreed services due to our own default, we will negotiate a fair remedy, which may include partial refunds or service credits. Refunds are handled on a case-by-case basis.
7. Intellectual Property
7.1 Ownership of Deliverables
Upon receipt of full payment, tekko.id assigns to you all right, title, and interest in the custom work product specifically created for your project ("Deliverables"), including any associated intellectual property rights, except as noted in Section 7.2.
7.2 Pre-existing and Third-Party Materials
We retain ownership of all pre-existing materials, tools, frameworks, libraries, methodologies, and know-how developed independently of your project ("Background IP"). We grant you a non-exclusive, perpetual, royalty-free license to use any Background IP incorporated into the Deliverables, solely for the purposes for which the Deliverables were created.
Any third-party open-source software or licensed components included in the Deliverables remain subject to their respective licenses. We will disclose the use of such components and their license terms upon request.
7.3 Portfolio Rights
Unless expressly prohibited in writing, we reserve the right to display your project in our portfolio, case studies, and marketing materials. This includes descriptions, screenshots, and general metrics. We will not disclose confidential business information without your consent.
7.4 Our Intellectual Property
All content on the tekko.id website, including but not limited to text, graphics, logos, images, and software, is the property of tekko.id and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written permission.
8. Confidentiality
Both parties acknowledge that during the engagement, each may have access to confidential information of the other party ("Confidential Information"), including but not limited to business plans, technical data, financial information, client lists, and trade secrets.
Each party agrees to:
- Keep all Confidential Information strictly confidential and not disclose it to any third party without prior written consent
- Use Confidential Information only for the purpose of performing obligations under the project agreement
- Limit access to Confidential Information to personnel who need it to perform the work
- Promptly notify the other party of any unauthorized disclosure or use
These obligations survive the termination of the engagement for a period of 3 years. A separate Non-Disclosure Agreement (NDA) may be executed upon request.
9. Warranties & Disclaimers
9.1 Our Warranties
tekko.id warrants that:
- We have the right to enter into these Terms and perform the agreed services
- The Deliverables, to the best of our knowledge, will not infringe on any third-party intellectual property rights
- We will perform services with reasonable skill and care in accordance with industry standards
9.2 Disclaimer of Warranties
Except as expressly stated above, services are provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the software we develop will be error-free, uninterrupted, or that it will meet any specific business objectives or financial outcomes. Business results depend on many factors outside our control.
10. Limitation of Liability
To the maximum extent permitted by applicable law, tekko.id's total liability to you for any claims arising from or related to these Terms or the services provided shall not exceed the total amount paid by you to us in the 12 months preceding the event giving rise to the claim.
In no event shall tekko.id be liable for any:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, goodwill, or business opportunities
- Damages resulting from your inability to use the services
- Losses arising from third-party actions, including hacking, data breaches, or service interruptions outside our reasonable control
Some jurisdictions do not allow the limitation of certain warranties or the exclusion of certain damages, so some of the above limitations may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless tekko.id and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from:
- Your violation of these Terms
- Your use of the Deliverables in a manner not authorized by these Terms or applicable law
- Any content, data, or materials you provide to us that infringe on third-party rights
- Your negligence or willful misconduct
12. Termination
12.1 Termination by Either Party
Either party may terminate the engagement with 14 days' written notice if the other party materially breaches these Terms or the project agreement and fails to cure such breach within that notice period.
12.2 Termination by Client
You may terminate an engagement at any time by providing written notice. Upon termination:
- You will pay for all work completed up to the date of termination, including any non-cancellable costs or third-party fees we have incurred on your behalf
- The upfront deposit is non-refundable if work has commenced
- We will deliver all completed work product in a reasonable handover format
12.3 Termination by tekko.id
We reserve the right to immediately suspend or terminate services if you:
- Fail to make payment within the agreed timeframe
- Use our services or Deliverables for unlawful purposes
- Engage in abusive, threatening, or harassing behavior toward our team
12.4 Effect of Termination
Sections relating to intellectual property, confidentiality, payment obligations, warranties, limitation of liability, indemnification, and dispute resolution shall survive the termination of these Terms.
13. Dispute Resolution
13.1 Good Faith Negotiation
In the event of any dispute, controversy, or claim arising out of or relating to these Terms or the services provided, the parties agree to first attempt to resolve the matter through good faith negotiation. Either party may initiate this process by providing written notice describing the dispute in reasonable detail.
13.2 Mediation
If the dispute cannot be resolved through negotiation within 30 days, the parties agree to submit the matter to mediation before a mutually agreed-upon mediator in Indonesia.
13.3 Arbitration
If mediation is unsuccessful, any dispute shall be finally resolved by binding arbitration under the rules of the Badan Arbitrase Nasional Indonesia (BANI). The arbitration shall be conducted in Bahasa Indonesia or English (by mutual agreement) in Jakarta, Indonesia.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions. For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the courts located in Jakarta, Indonesia.
15. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Notify existing clients via email with at least 14 days' advance notice
- Display a prominent notice on our website
For new engagements, the Terms in effect at the time of signing the project agreement shall apply. For ongoing engagements, changes become effective 14 days after notification, unless you notify us of your objection within that period.
Your continued use of our services after the effective date of any changes constitutes your acceptance of the revised Terms.

These Terms of Service constitute the entire agreement between you and tekko.id with respect to your use of our services and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and tekko.id.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
